(Amending Ordinance No. 944)

AN ORDINANCE ACCEPTING PROPOSED MODIFICATIONS IN CABLE TELEVISION SERVICES AND CONSENTING TO AND APPROVING THE TRANSFERAND ASSIGNMENT BY KARLEN COMMUNICATIONS, INC., OF ALL OF ITS RIGHT, TITLE AND INTEREST IN THE FRANCHISE GRANTED TO IT PURSUANT TO ORDINANCE NO. 944 TO MULTIMEDIA CABLEVISION, INC.

Section 1. The modifications in cable television service contained in the proposal dated July 25, 1986 are hereby accepted by the city and such proposal shall be effective in accordance with its terms and with applicable federal law. All Terms, conditions and obligations contained in Ordinance No. 944 of the City of Hoisington, Kansas dated December 6, 1976 shall remain in full force and effect except as such terms may be modified by such proposal and except that the expiration date of the franchise granted by such ordinance shall be December 6, 1998.

Section 2. The transfer and assignment by Karlen Communications, Inc. of all of its right, title and interest in and to the franchise granted to it, its successors and assigns, by Ordinance No. 944 of the City of Hoisington, Kansas, dated December 6, 1976 to Multimedia is hereby consented to and approved. Section 3. Multimedia shall assume and faithfully perform all of the terms, conditions and obligations required of the franchisee in said Ordinance No: 944 except as such terms may be modified herein or by applicable federal law.
